SenoRx Inc., an Aliso Viejo maker of devices to diagnose and treat breast cancer, said Tuesday that a federal judge denied a request by Hologic Inc. for an injunction against it.
Cytyc Corp., which Massachusetts-based Hologic bought last year, sued SenoRx in January for alleged patent infringement of a catheter used to deliver targeted radiation to a tumor.
The court’s action allows SenoRx to continue selling its Contura MLB catheter.
SenoRx said the court ordered it and Hologic to schedule a trial within 60 to 90 days.
Wall Street responded, sending SenoRx’s shares up 10% at the close of Nasdaq trading with a market value of about $120 million.
Hologic counted a recent market value of $7.4 billion.
SenoRx, which went public in early 2007, also makes the EnCor vacuum-assisted breast biopsy system.
