A high-profile battle over Botox officially is over.
Irvine-based Allergan Inc. said Tuesday that Irena Medavoy, wife of Hollywood mogul Michael Medavoy, has dropped her appeal of a Botox verdict that went against her.
In October, a jury ruled in favor of Allergan and a celebrity dermatologist in a lawsuit over Botox treatment brought by Irena Medavoy. She appealed the verdict in January.
Allergan disclosed the dropping of the appeal in a recent Securities and Exchange Commission filing.
Allergan said Medavoy dropped her appeal on Aug. 3 as part of a settlement with the company. Allergan said it paid no money and agreed to release her from any claims that arose from the trial, including malicious prosecution.
The drug maker also said that Medavoy agreed to reimburse it for a portion of its costs in defending the lawsuit.
Medavoy originally sued Allergan and Arnold Klein, a dermatologist and Allergan consultant, in early 2003, alleging that she was injured from Botox injections for treating her migraine headaches.
Botox, Allergan’s flagship wrinkle-removing neurotoxin, isn’t approved for migraines but can be prescribed by doctors an “off-label” treatment. Allergan is conducting clinical trials of the drug’s effectiveness in treating migraines.
A Los Angeles Superior Court jury found in favor of Allergan and Klein last fall. The court entered a judgment against Medavoy and ordered her to reimburse Allergan $310,000 for court costs incurred in defending the lawsuit.
