Device Maker’s Court Win Upheld

A federal appeals court has upheld a $64.5 million judgment in favor of Rancho Santa Margarita-based Applied Medical Resources Corp. against Tyco International Ltd.’s U.S. Surgical Corp. unit.

Applied Medical had sued Tyco over a patent related to a laparoscopic surgical device. An Orange County jury found that U.S. Surgical had infringed the Applied Medical patent.

The jury awarded Applied Medical $43.5 million in damages, along with $21 million in increased damages and legal fees.

A Tyco spokeswoman told Reuters the product was taken off the market in 2002 and that the New Jersey-based company already had prepared for the judgment.
