Another Broadcom Court Win; Said To Be in Talks With Qualcomm

Irvine’s Broadcom Corp. is said to be in talks with San Diego-based Qualcomm Inc. to settle a long-running battle over intellectual property rights for cell phone chips, according to reports.

The companies are said to be in settlement talks but it’s unclear if an agreement,perhaps in the form of a licensing deal,could come soon, Reuters reported on Wednesday.

“We’ve continued to engage in settlement discussions with them … but we don’t have anything to report on that front,” Alex Rogers, a Qualcomm senior vice president and legal counsel told Reuters. “I can’t tell you that there’s anything imminent.”

The two chipmakers have been sparring in Santa Ana and San Diego courts for the better part of three years over intellectual property issues and the legal remedies for patent infringement of various technologies for cell phones.

Broadcom scored a minor win earlier today when a federal appeals court upheld an earlier decision that Qualcomm had infringed on two of its chip patents.

The court also upheld a ban on certain Qualcomm chips and denied Qualcomm’s request for a new trial.

“The appeals court’s decision is a major victory for Broadcom in our ongoing effort to protect our intellectual property,” David Rosmann, vice president of intellectual property litigation, said in a statement.

Last month, a Santa Ana judge found that Qualcomm violated the injunction by continuing to sell cell phone chips that Broadcom Corp. had patented and by failing to pay royalties on time.

Broadcom’s shares closed up nearly 6% on a recent market value of about $10 billion.
