Jury Finds in Favor of Broadcom in Qualcomm Suit

A Santa Ana jury decided Tuesday that Qualcomm Inc. infringed three cell phone chip patents owned by Irvine’s Broadcom Corp.

Qualcomm illegally used Broadcom’s technology for chips for downloading and sending video and other data from cell phones, according to the decision.

After a three-week trial, the jury said that Qualcomm “willfully infringed” the patents and should pay a minimum of about $20 million in damages.

The “willful infringement” decision allows the judge to award as much as $60 million if he chooses.

“This is a complete victory for Broadcom,” David Rosman, Broadcom’s lawyer, told Bloomberg.

In addition to damages, Broadcom is likely to seek an order that would ban San Diego-based Qualcomm from putting the chips into phones.

In another matter, the International Trade Commission delayed issuing penalties late Friday to Qualcomm, which was found to have infringed five claims on patented chips made by Broadcom back in October.

In December, the ITC committee upheld the judge’s decision and said that Qualcomm infringed five claims of a Broadcom patent.

A penalty ruling against Qualcomm now is due on June 7.

Tuesday’s jury decision is one in a long string of legal battles that go back more than two years. The lawsuits have taken a “tit-for-tat” pattern.

In January, a San Diego federal court found that Broadcom did not infringe two Qualcomm patents related to video compression.

Separately, Broadcom last month filed a complaint against Qualcomm that goes after its licensing strategies.

The complaint alleges that Qualcomm defied the norms of technology standards bodies, including concealing patents and breaking licensing agreements.
