Allergan Appeals Generic Court Loss
Irvine-based drug maker Allergan Inc. said it plans to appeal a judge’s rejection of its lawsuit aiming to block rivals Alcon Laboratories Inc. and Bausch & Lomb Inc. from selling generic versions of its glaucoma treatment until after patents expire.
Allergan’s suit alleges infringement of method-of-use patents relating to its Alphagan ophthalmic solution.
Last week, a judge dismissed Allergan’s suit against Alcon saying holders of drug method-of-use patents can’t sue for inducement of patent infringement.
